Welcome to Mac Paint Contractors LLC (“we,” “us,” or “our”). By accessing our website, requesting an estimate, signing a proposal, or hiring our company for any service, you (“client,” “customer,” or “you”) agree to the following Terms of Service. Please read them carefully.

1. Scope of Work

All services provided will be performed according to industry standards and manufacturer specifications.
The specific scope of work will be detailed in your written estimate or proposal.

Any item not explicitly included in the proposal is excluded from the scope.
Changes or additions will require a written change order and may result in additional charges.

2. Estimates & Pricing

All estimates are valid for 30 days unless stated otherwise.

Pricing is based on reasonable access to the project site.

Unforeseen conditions (e.g., structural issues, hidden damage, mold, termites, electrical hazards) may require additional work at additional cost.

We reserve the right to update pricing if conditions differ from initial expectations.

3. Client Responsibilities

The client agrees to:

Provide safe and reasonable access to the property.

Remove furniture, valuables, and obstacles unless otherwise arranged.

Secure pets and ensure safety for children around work areas.

Obtain necessary permits unless otherwise stated in writing.

Notify us of any special building requirements, HOA rules, or restrictions.

We are not responsible for delays caused by lack of access or site readiness.

4. Scheduling & Delays

Timelines are estimates only. Work schedules may be adjusted due to:

Weather conditions

Limited access

Material availability

Change orders

Safety concerns

Acts of nature or circumstances beyond our control

We will communicate all changes as promptly as possible.

5. Payments & Fees

Payment terms will be specified on the estimate, invoice, or contract.
Unless otherwise stated:

Payments must be made according to the agreed schedule.

Past-due balances accrue 1.5% monthly interest.

The client agrees to pay all collection costs, including attorney fees and court costs.

Mac Paint Contractors LLC reserves the right to pause work for late or missing payments.

6. Warranty

A warranty may be provided depending on the service performed. Warranty details will be provided upon project completion.
Warranty does not apply to:

Normal wear and tear

Damage caused by external forces (weather, moisture, movement, impact, etc.)

Unauthorized repairs or alterations

Pre-existing conditions or structural issues

7. Materials & Jobsite Conditions

We may substitute equivalent materials if original selections are discontinued or unavailable.

The client agrees to maintain a safe jobsite.
We reserve the right to stop work if unsafe conditions are identified.

8. Liability Limitations

Mac Paint Contractors LLC is not liable for:

Damage to landscaping, personal property, or surfaces not properly protected by the client

Delays caused by factors outside our control

Existing structural, electrical, or environmental issues uncovered during work

Our liability is limited to the value of the contract.

9. Cancellations

If the client cancels after materials are purchased or work has started, the client is responsible for:

Material costs

Labor performed to date

Any restocking or cancellation fees

10. Termination of Services

We reserve the right to terminate services for:

Unsafe conditions

Non-payment

Client misconduct or interference

Failure to comply with contract terms

The client is responsible for all work completed up to the date of termination.

11. Use of Photos & Project Documentation

We may document projects with photos or videos for quality control and portfolio use.
If you wish to opt out of marketing use, please notify us in writing before work begins.

12. Website & Digital Use

By using our website, you agree not to engage in misuse, unauthorized data access, or harmful activity.
Any digital content (images, text, designs, etc.) is owned by Mac Paint Contractors LLC unless otherwise stated.

13. Governing Law

These Terms of Service are governed by the laws of the State of Florida.
In the event of legal action, the exclusive venue shall be Miami-Dade County, Florida.

14. Updates to Terms

We may update these Terms of Service at any time.
Revisions take effect upon posting. Continued use of our services signifies acceptance of updates.
